The duty of the school to manage the risk from Asbestos is governed by legislation; however the moral duty to protect staff and pupils from the risk of Asbestos related diseases will no doubt be of uppermost concern to your school. If your school is believed to contain Asbestos, then you should have on the premises a survey detailing where Asbestos is believed to be situated and also the state of the Asbestos. Depending on the control measures suggested by your survey there may be a need for remedial work and also a need for a review of your survey at a set interval. Furthermore, if contractors are going to work in your school and there is a potential for them to disturb the areas containing asbestos, then you have a legal duty to inform the contractor of the presence and location of this harmful substance. Should a contractor work on your premises and disturb Asbestos due to a lack of awareness, then aside from potentially lethal health problems for the contractor the school will face the prospect of a legal prosecution.
